If your parents owned property in their individual name without a trust, California probate court will likely be required. The process typically takes 9–18 months and involves court supervision and attorney fees based on the estate value. The good news: if the estate has full IAEA authority, the property sale can move similarly to a regular transaction. Knowing which situation you're in is the first thing we sort out together.
This is more common than you'd think — and it's one of the most important things a good agent does. We bring objective market data to the table, walk everyone through what the home is actually worth today, and make sure all siblings hear the same information at the same time. When decisions are grounded in facts rather than feelings or family history, alignment usually follows.
It depends entirely on the home and the market — and the answer is different for every property. The key question is ROI. Some updates — fresh paint, refinished floors, landscaping — routinely return more than they cost. Others don't. Since every dollar spent comes out of the estate, we're careful about this. We'll walk through the specific property with you and give you a clear picture of what's worth doing and what isn't.
California's Prop 13 caps annual property tax increases at 2% for existing owners — so parents in a home for 20–30 years often have a very low effective tax rate. That rate does not transfer to a new buyer, who resets to current assessed value at purchase. For children inheriting and keeping the home, there may be partial reassessment exclusions — a question for an estate attorney. For the sale itself, the buyer's tax reset is simply a factor in how the home is priced and marketed.
It depends on the legal path. A trust sale can move like a normal transaction: 45–90 days from listing to close. A probate sale typically takes 9–18 months. Beyond the legal path, the cleanout and prep phase takes 4–8 weeks before the home is ready to list. The earlier you start, the less rushed that process feels — and the better the outcome.
Yes — and it happens more often than people expect. The key is establishing fair market value that all parties agree on, which is exactly what a proper home valuation provides. The buying sibling would need to qualify for financing or have sufficient liquid assets.
